Seller Assist Owner Carryback Program Requirements
On this page there are links to the forms necessary to
complete a transaction with the Seller Assist Owner Carryback Program. If additional forms or paperwork
are required, we will provide them as needed. There is no avoiding paperwork
in any real estate transaction but it's not as bad as it looks. In fact, taken
step-by-step, it's a snap. We will help you all the way. Don't forget that the
disclosure forms are for your protection. You should package and submit the
note purchase documentation direct to Cash Out $ervices yourself, but we are always ready to
help you with this.
Please note that in making these forms available, we are
doing so for your convenience only and are not offering legal advice. With
respect to the Home Selling Transaction, you are free to use any forms you wish.
The only form we require that you do use is the Acknowledgment of Non Agency
Relationship (B&A) (Word file).
While we explain the
various procedures involved and and the kinds of documentation and disclosures
required in a California real estate transaction, all financial details and
responsibilities must be negotiated direct between Seller and Buyer. Except for
our local (Palm Springs Desert Area) transactions, we are not
in a position to provide oversight or review of the completion of documentation
actually used in the transaction.
We encourage local realtor or attorney review of your
transaction and will pay the reasonable costs involved. When choosing an
attorney, be sure to select one experienced in real estate transactions. There are no copyright issues
with respect to the first tuesday forms, since we have reprint rights.
However, bear in mind that these forms are California-specific. Be guided by
your local professional in the appropriate forms to use.
The forms are either in HTML, Adobe (pdf), or MS Word format. You can print HTML forms straight from your screen. To open
and print Adobe files, you will need to download Adobe Acrobat Reader. There are
how-to instructions about Adobe at the end of this page. To open MS Word files,
you need MS Works or MS Word.

Phase I - Preapproval Process

Upon satisfactory review of Phase I documents, a Mortgage
Purchase Letter of Intent is issued. An example is at this link: Letter of
Intent (Word file) It will contain a checklist of items
necessary to submit for Phase II. Upon Seller's and Buyer's approval of the
terms listed in the Letter of Intent, the Earnest Money and Sales Contract are
submitted to Escrow for Title Commitment preparation.
Phase II - Collection of Required Documents

Copy of Buyer(s) Photo ID
Copy of Buyer(s) Social Security Card
Original Full Appraisal
(Word file) with interior inspection and
comparable photographs from approved appraisal firm only.
Phase III - Preparation for Closing

Request for further documentation, if needed.

Title Commitment, Tax Certificate, Agent Certification, and
Insured Protection Letter ordered and obtained.

Buyer(s) notified to have one year pre-paid hazard
insurance policy in place before closing.
Phase IV - Closing

Closing package sent from Funder to Escrow.

Seller(s) and Buyer(s) execute closing documents.

Escrow faxes all executed documents to funder for final
document review and approval. (Original documents are held in Escrow and are
not recorded until funding arrives in Escrow)

Funds are wired to Escrow for disbursement. Allow 3 days
for funding disbursements.
