2. We will use Seller Financing
to get you Full Price
If you have little or no equity, or you want cash flow, we will help you
sell on terms. We will buy your property, at or near your asking
price, utilizing the traditional "seller financing" methods of Lease Option,
Contract for Deed, or
All-Inclusive Trust Deed (AITD).
With all three methods, you will stay on the loan (if there is one). With the AITD, title passes. With the Lease Option or Contract for
Deed, you retain
title. With all three methods there is some risk of "due on
sale" problems with your lender. In addition, with the AITD, there may be a problem regaining
title through foreclosure. Also, with the Contract for Deed or Lease Option, there may
be problems evicting a non-performing occupant who claims equity.
California Land Trust
Besides these "traditional" seller financing methods, we
also use the
safer alternative vehicle of a title-holding land trust established by the property owner. You can sell your home but retain
your equity as an investment without putting
your title in jeopardy and with no risk from a violation of the
"due-on-sale" clause in your
loan.
Utilizing a California Land Trust, we will buy your property at full
appraised value in such a way
that you can safely stay on the loan without "due on sale
" problems or risk to title. Full appraised value recognizes the
favorable terms you are giving. The appraisal is performed at the
termination of the trust, when title is passed to the eventual buyer.
This manner of execution with an Illinois-type California land trust (PACTrust™)
established by North
American Realty Services avoids the pitfalls associated with
old-school "creative
financing" and effectively "modernizes" these very useful
real property disposition strategies.
An additional benefit is that our company's position in the trust helps
guarantee performance by the ultimate Buyer. The only downside to the
Seller is
the (modest) cost of establishing the trust.
Special note for Landlords:
If
you intend eventually to dispose of the property, the PACTrust™ can be
structured in such a way that you can in the mean time get an above-market
rent; get relief from
your maintenance responsibilities; have zero management
expenses; have
a third party guarantee your tenant's performance.
How do we work?
Whichever of the two basic methods is appropriate,
we work on the basis of a simple, no strings agreement to buy the property. You
are free to cancel the agreement on only seven days notice. There is no cost or risk to you. Click

even continue to market the property in the regular way, "By
Owner," or utilizing the
services of a real estate agent. Just make sure that there is an appropriate exclusion
in your listing agreement - to the effect that your agent is not entitled to a
commission when we purchase the property.
Regardless, we won't tie up your property
for months on end in the manner required by the typical listing agreement.
We will market your house at our
expense and using
our resources. We only
get paid if we are successful.
