Think of the Trust as a
Corporation that owns the house.
1. Shares in the Corporation are allotted to the person on the note (the
Seller), the Investor, and the Buyer. In trust terminology this allotment of
shares is called "Allocation of Beneficial Interest." And the
Shareholders are called "Beneficiaries."
2. Then an Agreement between the Shareholders (Beneficiaries) is drawn up
which lays out how the Corporation (the Trust) will be run, and who gets what,
when and how. This is called the "Beneficiary Agreement."
3. The Corporation (the Trust) then leases the house to one of the Shareholders
(Beneficiaries). The Resident Shareholder, who is the Buyer, is known as the
"Resident Beneficiary." The lease document drawn up between the
Company President (the Trustee) and the Resident Shareholder (Resident
Beneficiary) is known as the "Use and Possession Agreement."
